Acceptable Use Policy

This Acceptable Use Policy (“AUP”) explains how customers may use services provided by PriortechLabs (“PriortechLabs”, “we”, “us”, or “our”).

This AUP applies to all PriortechLabs services, including web hosting, reseller hosting, VPS services, email hosting, domain-related services, DNS services, SSL services and other infrastructure or digital services provided by PriortechLabs.

The purpose of this AUP is not to control legitimate websites or businesses. It exists to protect our customers, our network, our infrastructure, third parties and the wider internet from unlawful, abusive, harmful or disruptive activity.

By using a PriortechLabs Service, you agree to comply with this AUP. This AUP forms part of the PriortechLabs Terms of Service.

1. General Requirement

1.1. PriortechLabs Services must be used responsibly, lawfully and in a manner that does not interfere with other customers, our infrastructure, our service providers or the wider internet.

1.2. You are responsible for all activity conducted through your account, including activity performed by:

  • You;
  • Your employees;
  • Your contractors;
  • Your website visitors;
  • Your customers;
  • Your developers;
  • Your agents;
  • Any person to whom you provide access; or
  • Any person who gains access to your account because you failed to maintain reasonable security.

1.3. Giving another person access to your hosting account does not transfer responsibility away from you.

1.4. If you operate reseller hosting, you are responsible for ensuring that your customers comply with this AUP.

2. Compliance With the Law

2.1. You must comply with all applicable laws and regulations when using PriortechLabs Services.

2.2. For customers operating in Tanzania, this includes applicable laws of the United Republic of Tanzania.

2.3. Depending on the activity involved, applicable legislation may include laws relating to cybercrime and unauthorised computer access, electronic transactions and electronic communications, personal data and privacy, intellectual property and copyright, consumer protection, financial and payment services, telecommunications, defamation and unlawful threats, fraud and financial crime, and other applicable civil or criminal law.

2.4. International customers are responsible for complying with laws applicable to their activities and jurisdictions.

2.5. A customer must not use the fact that a server is physically located in another country as a reason to avoid laws that apply to the customer’s activities.

3. Illegal Activity

You may not use PriortechLabs Services to commit, facilitate, encourage, organise or conceal unlawful activity. This includes, but is not limited to:

  1. fraud or attempted fraud;
  2. identity theft;
  3. financial scams;
  4. phishing;
  5. unauthorised access to computer systems;
  6. distribution of stolen credentials;
  7. distribution of unlawfully obtained personal information;
  8. malware distribution;
  9. ransomware;
  10. unauthorised interception of communications;
  11. unlawful surveillance;
  12. cyberattacks against third-party systems;
  13. extortion;
  14. blackmail;
  15. unlawful threats;
  16. trafficking in stolen data;
  17. operation of criminal marketplaces;
  18. distribution of content prohibited by applicable law;
  19. money laundering or facilitating financial crime; or
  20. any other activity that violates applicable law.

4. Hacking and Unauthorised Access

4.1. You may not use PriortechLabs infrastructure to gain or attempt to gain unauthorised access to computers, servers, networks, applications, accounts or other systems.

4.2. Prohibited activity includes:

  • Password attacks;
  • Credential stuffing;
  • Brute-force attacks;
  • Exploiting vulnerabilities without authorisation;
  • Unauthorised penetration testing;
  • Unauthorised vulnerability scanning;
  • Port scanning of third-party systems;
  • Exploiting stolen credentials;
  • Bypassing authentication;
  • Privilege escalation;
  • Installing unauthorised backdoors;
  • Maintaining unauthorised access;
  • Circumventing security controls; or
  • Attempting to interfere with security systems.

4.3. Security research, penetration testing and vulnerability assessment may only be conducted where you have appropriate authorisation from the owner of the system being tested.

4.4. You must not conduct security testing against PriortechLabs infrastructure without our prior written permission.

5. Malware and Malicious Software

5.1. You may not knowingly host, distribute, transmit or operate malware through PriortechLabs Services.

5.2. Prohibited malware includes, but is not limited to: viruses, worms, trojans, ransomware, spyware, keyloggers, credential stealers, remote-access malware, botnet software, malicious browser extensions, web shells, cryptojacking malware, malicious scripts, and other software primarily designed to compromise, damage or obtain unauthorised access to systems or data.

5.3. If legitimate software is accidentally compromised or infected, you must take reasonable steps to remove the infection after being notified.

5.4. PriortechLabs may temporarily restrict a compromised account where necessary to prevent further damage.

6. Phishing and Impersonation

6.1. PriortechLabs has zero tolerance for phishing operations.

6.2. You may not use our Services to create, host, distribute or operate websites, emails or other systems designed to deceive people into providing passwords, authentication codes, banking information, payment information, identification information, personal information, cryptocurrency credentials, account credentials, or other confidential information.

6.3. You may not impersonate banks, financial institutions, government agencies, businesses, schools, employers, individuals, service providers, payment processors, domain registrars, technology companies, or other organisations or persons.

6.4. Legitimate demonstrations, security training and educational projects must not be used as a cover for collecting real people’s credentials or personal information.

7. Spam and Email Abuse

7.1. PriortechLabs Services must not be used to send spam or unsolicited bulk email.

7.2. Prohibited email activity includes: sending unsolicited commercial email, purchasing or using scraped email lists for bulk campaigns, sending email to harvested addresses, operating spam networks, using compromised accounts to send bulk email, email bombing, mail flooding, forging email headers, falsifying sender information, attempting to bypass spam filters, sending malicious attachments, sending phishing messages, or deliberately causing another mail server to receive excessive unwanted traffic.

7.3. Email recipients should be able to reasonably understand who is sending the message and why they are receiving it.

7.4. Where applicable, customers must provide recipients with a reasonable method of opting out of marketing communications.

7.5. Customers are responsible for ensuring that their mailing practices comply with applicable privacy, electronic-communications and anti-spam laws.

7.6. PriortechLabs may temporarily restrict outgoing email from an account that is compromised or generating abusive email traffic.

8. Bulk Email and Marketing

8.1. Legitimate newsletters, transactional email and business communications may be permitted where the customer has an appropriate basis for sending them and complies with applicable laws.

8.2. Sending large volumes of email through shared hosting may not be appropriate for the Service.

8.3. Where email volume materially affects server reputation, delivery, performance or other customers, PriortechLabs may require the customer to move to an appropriate email or mail-delivery solution.

8.4. PriortechLabs may limit, throttle or temporarily restrict email traffic where necessary to protect our infrastructure or network reputation.

9. Denial-of-Service and Network Attacks

9.1. You may not use PriortechLabs Services to conduct, coordinate, facilitate or knowingly participate in denial-of-service attacks, distributed denial-of-service attacks, traffic flooding, packet flooding, network disruption, service exhaustion, reflection or amplification attacks, botnet activity, or similar attacks.

9.2. You may not intentionally generate traffic designed to make another person’s website, server, network or service unavailable.

9.3. You may not use PriortechLabs infrastructure as an attack platform against another provider.

10. Resource Abuse

10.1. Shared hosting resources are provided on a shared basis.

10.2. You must not use your account in a manner that places an unreasonable or sustained burden on shared infrastructure.

10.3. Examples include excessive CPU usage, RAM usage, disk I/O, database queries, running processes, simultaneous connections, network traffic, file operations, cron jobs, email activity, or other server resources.

10.4. Resource limits may vary between hosting plans.

10.5. If your website legitimately requires additional resources, PriortechLabs may recommend a higher hosting plan, VPS or another appropriate Service.

10.6. We will generally attempt to work with customers to resolve resource issues rather than immediately terminate an account.

10.7. Immediate restriction may occur where excessive resource usage causes a significant risk to server stability, security or other customers.

11. Cryptocurrency Mining

11.1. Cryptocurrency mining is not permitted on shared hosting services.

11.2. Customers using VPS or dedicated infrastructure may only conduct resource-intensive workloads where expressly permitted by their Service and where the activity does not violate applicable law or create abuse of the infrastructure.

11.3. PriortechLabs may restrict resource-intensive workloads that materially affect network or infrastructure stability.

12. Proxy, VPN and Network Services

12.1. Running proxies, VPNs, tunnelling services, Tor nodes, open relays or similar network services may be restricted depending on the Service.

12.2. Customers must not operate an open proxy or relay that allows unauthorised third parties to abuse PriortechLabs infrastructure.

12.3. Services designed primarily to conceal or facilitate unlawful activity are prohibited.

12.4. PriortechLabs may restrict network services that generate abuse complaints, security incidents or unreasonable resource consumption.

13. Open Relays

13.1. Customers must not operate open SMTP relays, open proxies, open DNS resolvers where they create a security or abuse risk, unsecured file-sharing services, or other publicly accessible services that can be readily abused by third parties.

13.2. Customers are responsible for appropriately securing services they operate.

14. Copyright and Intellectual Property

14.1. You may not use PriortechLabs Services to knowingly distribute material that infringes another person’s copyright, trademark, patent, trade secret or other intellectual-property rights.

14.2. This includes unauthorised distribution of software, movies, television programmes, music, books, games, photographs, courses, paid databases, premium website themes or plugins, licensed commercial material, or other copyrighted works.

14.3. You may host copyrighted material where you have the necessary rights, licence or permission to do so.

14.4. PriortechLabs may investigate credible intellectual-property complaints and may request information from the affected customer.

14.5. Where legally required or reasonably necessary, PriortechLabs may restrict access to allegedly infringing material while the matter is investigated.

15. Illegal File Sharing

15.1. PriortechLabs Services must not be used to operate services primarily intended to distribute pirated or unlawfully copied material.

15.2. This includes websites or systems whose primary purpose is the unauthorised distribution of copyrighted software, games, movies, music, books, courses, applications, or other digital works.

16. Personal Data and Privacy

16.1. Customers must not use PriortechLabs Services to unlawfully collect, process, expose, sell or distribute personal information.

16.2. If your website collects personal information, you are responsible for ensuring that you have an appropriate legal basis for doing so.

16.3. You should implement reasonable security measures appropriate to the type of personal information you process.

16.4. You must not intentionally publish or expose sensitive personal information belonging to another person without appropriate legal authority.

16.5. Customers operating in Tanzania must comply with applicable Tanzanian data-protection requirements, including the Personal Data Protection Act, 2022 and applicable regulations.

16.6. International customers must also comply with applicable data-protection laws governing their activities.

17. Child Safety

17.1. PriortechLabs will not knowingly permit its Services to be used for child sexual exploitation or child sexual abuse material.

17.2. Any such material or activity identified on our infrastructure may be subject to immediate restriction, preservation of relevant information and reporting to appropriate authorities where required or permitted by law.

17.3. Customers must not use PriortechLabs Services to facilitate the sexual exploitation, abuse or trafficking of children.

18. Fraudulent Websites and Scams

18.1. You may not host websites designed to intentionally deceive visitors or obtain money or information through fraudulent representations.

18.2. Examples include fake investment schemes, fake banking websites, fake payment pages, fake government websites, fake login pages, fake employment schemes, fake online stores, advance-fee scams, impersonation scams, fraudulent donation websites, and other deceptive schemes.

18.3. Legitimate businesses must provide sufficiently accurate information about the identity and nature of the business where required by applicable law.

19. Financial Services

19.1. PriortechLabs does not provide a licence for customers to conduct regulated financial activity.

19.2. If your business involves financial services, payments, lending, investments, insurance, cryptocurrency or another regulated activity, you are responsible for obtaining all licences, approvals and authorisations required by applicable law.

19.3. PriortechLabs may request evidence of appropriate authorisation where reasonably necessary to assess a legal or security concern.

20. Malicious or Deceptive SEO

20.1. Customers may use legitimate search-engine optimisation techniques.

20.2. You may not use PriortechLabs infrastructure primarily for automated search-engine manipulation, large-scale doorway pages, malicious redirects, hidden malware, search-engine spam, mass-generated deceptive websites, artificial traffic schemes, or other activity designed to deceive users or search engines.

21. Fake Traffic and Automated Abuse

21.1. You may not operate systems designed to generate fraudulent website visits, advertising clicks, advertising impressions, social-media engagement, reviews, registrations, votes, leads, or other artificial activity.

21.2. Automated systems must not be used to overwhelm third-party services or circumvent their usage restrictions.

22. Hosting Third-Party Services

22.1. Customers may host applications and services for their own customers where their PriortechLabs plan permits it.

22.2. The customer remains responsible for ensuring that hosted third parties comply with this AUP.

22.3. If your customers use your reseller or VPS service to conduct prohibited activities, PriortechLabs may require you to take corrective action.

22.4. Repeated abuse originating from a reseller account may result in restrictions on the reseller’s account.

23. Server and Account Security

23.1. Customers are responsible for keeping websites, applications, CMS installations, plugins and software reasonably secure and updated.

23.2. Customers should use strong passwords and, where available, multi-factor authentication.

23.3. Customers should remove unused applications, plugins, themes and accounts.

23.4. Customers should not knowingly leave vulnerable or compromised software connected to the internet.

23.5. If PriortechLabs informs you that your account has been compromised, you are expected to take reasonable steps to secure it.

24. Compromised Accounts

24.1. If we detect that an account has been compromised, PriortechLabs may temporarily disable outgoing email, suspend website access, block malicious traffic, disable affected processes, isolate affected files, reset selected credentials where technically appropriate, or fully suspend the account.

24.2. These actions may be taken without prior notice where immediate action is reasonably necessary to protect other customers or infrastructure.

24.3. Where practical, we will notify the customer and explain the general reason for the restriction.

24.4. Restoration may require the customer to demonstrate that the security issue has been addressed.

25. Abuse of DNS

25.1. DNS Services must not be used to facilitate phishing, malware, fraud, botnets or other prohibited activity.

25.2. Customers must maintain accurate DNS configurations for their domains.

25.3. PriortechLabs may modify or suspend DNS records where necessary to address an immediate security, legal or operational issue, subject to applicable law.

26. Abuse Reports

26.1. PriortechLabs may receive reports concerning spam, phishing, malware, copyright infringement, fraud, hacking, network attacks, child exploitation, security vulnerabilities, or other prohibited activity.

26.2. We may investigate credible reports.

26.3. Customers may be asked to provide information explaining the reported activity.

26.4. Customers are expected to respond within a reasonable period where action is required to correct an abuse issue.

26.5. Failure to respond to a serious abuse or security issue may result in suspension or termination.

27. Emergency Action

27.1. PriortechLabs may take immediate action where we reasonably believe that continued access to a Service could cause significant harm, facilitate a cyberattack, compromise other systems, distribute malware, cause significant network abuse, expose sensitive information, violate a legal requirement, or materially threaten the security or availability of our infrastructure.

27.2. Emergency actions may include blocking traffic, disabling services, suspending accounts or isolating affected systems.

27.3. Where legally and operationally possible, PriortechLabs will notify the affected customer after emergency action has been taken.

28. Content Removal and Access Restrictions

28.1. PriortechLabs is not responsible for actively monitoring every file, website, email or communication hosted by customers.

28.2. However, we may investigate Content or activity when we receive a credible complaint, security alert, legal request or other information indicating possible abuse.

28.3. Depending on the circumstances, we may request information from the customer, request removal or correction of Content, restrict access to affected Content, suspend a Service, preserve relevant information, report activity to an appropriate authority where required or permitted, or terminate the affected Service.

28.4. PriortechLabs will seek to take action proportionate to the nature and seriousness of the issue where circumstances permit.

29. Government and Law Enforcement Requests

29.1. PriortechLabs may comply with valid legal orders, warrants, notices and other lawful requests from competent authorities.

29.2. We may disclose information where required or permitted by applicable law.

29.3. Where legally permitted, PriortechLabs may notify customers of relevant requests.

29.4. We may not provide advance notice where doing so is prohibited by law or could interfere with a legitimate investigation or security matter.

30. Activities That May Require a Different Service

Some activities may be legitimate but unsuitable for shared hosting. Examples include:

  • High-volume email systems;
  • Large file distribution;
  • High-traffic applications;
  • Large databases;
  • Streaming platforms;
  • Resource-intensive applications;
  • Public API platforms;
  • High-volume data processing;
  • Large-scale automation;
  • Network-intensive applications; or
  • Other workloads requiring dedicated resources.

PriortechLabs may recommend moving such workloads to a VPS, dedicated server or another suitable Service.

31. Child or Minor Access to Services

31.1. Customers must comply with applicable laws concerning minors and online services.

31.2. Customers operating websites or services intended for children are responsible for implementing appropriate privacy, security and parental-consent practices where required by applicable law.

31.3. PriortechLabs does not assume responsibility for determining whether a customer’s website complies with laws applicable to children or minors.

32. Security Research

32.1. PriortechLabs supports responsible security research when properly authorised.

32.2. Customers must not test or attempt to exploit PriortechLabs infrastructure without prior written permission.

32.3. Customers conducting authorised security research must follow the scope and limitations agreed with PriortechLabs.

32.4. Security research must not involve accessing, modifying, deleting or exposing another customer’s data.

33. Resource Limits and Fair Use

33.1. Service plans may include published storage, bandwidth, CPU, RAM, process, database, email or other limitations.

33.2. Exceeding a published limitation may result in additional charges, restrictions, suspension or a recommendation to upgrade, depending on the Service.

33.3. “Unlimited” or similar descriptions, where used for a Service, do not mean that a customer may use resources without reasonable limitations.

33.4. Unlimited features remain subject to fair-use requirements and the prohibition against materially affecting other customers or infrastructure.

34. Prohibited Use of Shared Hosting

Unless PriortechLabs expressly approves the activity, shared hosting should not be used as infrastructure for:

  • Public file-sharing platforms;
  • Large-scale backup storage;
  • Large-scale video or media distribution;
  • Public download mirrors;
  • Mass email systems;
  • High-volume scraping;
  • Cryptocurrency mining;
  • Large-scale automation;
  • Public proxy networks;
  • Botnet infrastructure;
  • Attack infrastructure; or
  • Other workloads that are materially inconsistent with shared hosting.

35. Customer Responsibility for Third-Party Software

35.1. Customers are responsible for software they install.

35.2. PriortechLabs does not guarantee the security or compatibility of third-party applications, plugins, themes, scripts or software.

35.3. Customers should install software only from legitimate sources.

35.4. Pirated, cracked or illegally modified software must not be hosted or distributed through PriortechLabs Services.

36. Cracked Software and Licence Bypass

36.1. You may not use PriortechLabs Services to distribute or host software that has been illegally modified to bypass licensing or payment restrictions.

36.2. This includes cracked versions of applications, plugins, themes, games, operating systems, commercial scripts, or other licensed software.

36.3. Legitimately licensed software is permitted subject to its licence terms.

37. Unlawful Content

37.1. PriortechLabs does not knowingly permit content that is unlawful under applicable law.

37.2. Content restrictions may arise from applicable laws concerning child exploitation, terrorism, fraud, intellectual-property infringement, privacy, threats, defamation, financial crime, unlawful pornography, incitement to criminal conduct, or other prohibited activity.

37.3. PriortechLabs does not intend this section to prohibit lawful criticism, political discussion, journalism, research, educational material or legitimate expression protected by applicable law.

37.4. Where there is a genuine dispute regarding Content, PriortechLabs may consider the available information and applicable legal requirements before taking action, except where immediate action is necessary.

38. Enforcement

If PriortechLabs determines that this AUP may have been violated, we may take one or more of the following actions:

  1. Contact the customer;
  2. Request additional information;
  3. Request that the activity stop;
  4. Request removal or correction of Content;
  5. Disable a specific feature;
  6. Block abusive traffic;
  7. Restrict outgoing email;
  8. Temporarily suspend the affected Service;
  9. Suspend the customer account;
  10. Preserve relevant technical information;
  11. Report activity to an appropriate authority where required or permitted;
  12. Terminate the affected Service; or
  13. Take another reasonable measure necessary to protect our customers, infrastructure or legal interests.

The action taken will depend on the nature, seriousness and circumstances of the violation.

39. Immediate Suspension

PriortechLabs may suspend a Service without advance notice where we reasonably believe immediate action is necessary to address a cyberattack, malware, phishing, severe spam, compromised infrastructure, significant resource abuse, fraud, serious unlawful activity, a serious threat to another person, a significant threat to PriortechLabs infrastructure, or a legal requirement.

Where practical, the customer will be informed after the action has been taken.

40. Repeat Violations

40.1. Repeated violations may result in stronger enforcement action.

40.2. A customer who repeatedly receives abuse complaints, repeatedly fails to correct security problems or repeatedly violates this AUP may have their Service suspended or terminated.

40.3. PriortechLabs may consider the customer’s previous compliance history when determining appropriate action.

41. False Abuse Reports

41.1. PriortechLabs takes abuse reports seriously.

41.2. However, knowingly submitting false, fraudulent or malicious abuse reports designed to harm another customer is itself prohibited.

41.3. PriortechLabs may disregard reports that are clearly fraudulent, abusive or unsupported.

42. Customer Cooperation

42.1. Customers must reasonably cooperate with PriortechLabs when investigating serious security or abuse incidents involving their Services.

42.2. Cooperation may include providing relevant information, securing compromised accounts, removing malicious files, updating vulnerable software, responding to abuse notices, providing evidence of authorisation for disputed activity, or taking other reasonable corrective measures.

42.3. Refusal to cooperate may result in continued restriction or termination where the underlying issue presents a material risk.

43. No Guarantee of Content Preservation After a Violation

43.1. If a Service is suspended or terminated for a serious AUP violation, PriortechLabs does not guarantee that the affected Content will remain accessible indefinitely.

43.2. Customers should maintain independent backups of important Content.

43.3. Where legally and technically possible, PriortechLabs may provide a reasonable opportunity for the customer to retrieve legitimate data following suspension or termination.

43.4. This may not be possible where the Content itself is unlawful, malicious, poses an immediate security risk, or where applicable law prevents continued access.

44. Third-Party Networks and Services

44.1. You must not use PriortechLabs Services to attack, disrupt or abuse another provider’s network or service.

44.2. You must also comply with the terms and acceptable-use policies of third-party services you connect to or use.

44.3. PriortechLabs may restrict traffic where a third-party provider has presented a credible security or abuse concern involving your account.

45. International Use

45.1. PriortechLabs serves customers internationally.

45.2. Customers outside Tanzania are responsible for ensuring that their activities comply with applicable local and international laws.

45.3. PriortechLabs may restrict activities where continuing to provide the Service would create a legal obligation or serious compliance risk.

45.4. Nothing in this AUP is intended to unlawfully restrict rights that cannot legally be excluded.

46. Changes to This AUP

46.1. PriortechLabs may update this AUP from time to time to address changes in technology, law, security threats, infrastructure or our Services.

46.2. The current version will be published on the PriortechLabs website.

46.3. Where a material change substantially affects existing customers, we will make reasonable efforts to provide appropriate notice.

46.4. Continued use of the Services after an updated AUP becomes effective constitutes acceptance of the updated AUP, subject to applicable law.

47. Relationship With the Terms of Service

47.1. This AUP forms part of the PriortechLabs Terms of Service.

47.2. A violation of this AUP may also constitute a violation of the Terms of Service.

47.3. If there is a conflict between this AUP and mandatory applicable law, the law will prevail.

47.4. If there is a conflict between this AUP and a separate written agreement with a customer, the separate agreement will control to the extent expressly agreed.

48. Reporting Abuse

If you believe a PriortechLabs-hosted service is being used for abuse, phishing, malware, fraud, spam, copyright infringement or another serious violation, please contact PriortechLabs through the contact information published on priortech.co.tz.

When submitting an abuse report, please provide enough information for us to investigate, such as:

  • The affected domain or IP address;
  • A description of the suspected abuse;
  • Relevant URLs;
  • Dates and times;
  • Screenshots or other supporting evidence where appropriate; and
  • Your contact information.

Please do not include unnecessary personal or confidential information in an abuse report.

49. Final Provision

PriortechLabs wants customers to be able to run legitimate websites, applications, businesses, communities and online services without unnecessary interference.

This AUP is therefore intended to address actual abuse, unlawful activity, security threats and material disruption, rather than ordinary lawful use of hosting services.

Where an issue can reasonably be resolved without suspension or termination, PriortechLabs may, depending on the circumstances, give the customer an opportunity to correct the problem.

However, PriortechLabs reserves the right to take immediate action where necessary to protect customers, infrastructure, third parties or comply with applicable law.
